Leave entitlements in different states as per Act

Dear Friends,

Every state has different entitlement of leaves for employees. Please find attached worksheet mentioning leave entitlement for various states.

Need your valuable submission on the below query.

Q1 Does Contractual Employee are eligible for Maternity Benefit e.g. Leave / Medical Bonus / Claim of Maternity Benefit and Payment thereof ?

Q2 If covered under ESIC Act, does Contractual Employee is eligible for Maternity Benefit?

Q3 If Contractual Employee happens to be Expat - International Worker does she is eligible for the Maternity Benefit ?

Dear Azim,

Here are my reverts on your query.

Q1 : All employees including contractual workers should be treated similar to permanent employees hence eligible for maternity and other leaves

Q2: If anyone covered under ESIC, should take maternity benefits from ESI and not from employer.

Q3: To the best of my knowledge, international worker working in India should be given maternity benefit
